Valley man charged with open lewdness
A Donora resident is facing indecent exposure and related charges after state police said employees witnessed a lewd act inside a restroom at a business in North Belle Vernon last month.
Calvin Aaron Horney, 23, is charged with misdemeanor counts of indecent exposure, open lewdness and disorderly conduct in connection with the alleged Sept. 7 incident.
The charges were filed Thursday at the office of Magisterial District Judge John E. Christner in Rostraver Township.
According to an affidavit of probable cause, troopers were called to the business around 9:25 p.m. after employees reported a customer performing a lewd act in a restroom.
According to court documents, a juvenile employee was cleaning the women’s restroom near closing time when the employee went to the men’s restroom and discovered Horney sitting naked on a toilet and allegedly performing a lewd act.
The employee immediately reported the incident to a co-worker, who approached the restroom and told Horney to leave.
The second employee told investigators that several knocks on the restroom door and requests for Horney to leave went unanswered.
According to the affidavit, Horney remained seated on the toilet, completely naked, while looking down at a phone.
The juvenile employee later saw Horney near the front register and became frightened, running back to the office, according to court documents.
Horney eventually left the restaurant and drove away.
Troopers obtained a license plate number and traced the vehicle to a Donora address.
Police subsequently identified Horney and conducted an interview at the Belle Vernon barracks.
When questioned about the alleged lewd act, Horney initially suggested employees may have misinterpreted what they witnessed, but later allegedly acknowledged the activity, according to the complaint.
Horney was fingerprinted, processed and released.
A preliminary hearing before Christner has not yet been set.
