South Allegheny School District filed an emergency injunction Friday in Allegheny County Court of Common Pleas requesting that Sun Coach Lines be required to provide transportation while the district and the company “either continue to try to resolve the dispute over payments through mediation or an arbitrator or judge makes a decision.”
Superintendent Dr. Lisa Duval issued a letter to families in which she announced a way for students who were attending or planning to attend school in person this week to head back to the classroom.
Court injunction
In a “Frequently Asked Questions” document released over the weekend, SA said the court has scheduled a hearing related to the emergency injunction for 1 p.m. today via a Microsoft Teams conference call with Judge John T. McVay Jr.
McKeesport-based Sun Coach Lines contacted the district Friday to say it was terminating transportation services. Owner David Sunstein alleges the district failed to make more than $800,000 in payments that were agreed upon for the 2019-20 and 2020-21 school years.
He claims SA hasn’t made full payments for more than 10 months and that payments were broken down into 10 equal monthly installments.
The company contends the “non-payment issue” began in March 2020 when schools transitioned to distance learning because of the coronavirus pandemic and that SA refused to make full payments to the company for March, April and May of 2020.
